Charles Marlow Rentals – Terms & Conditions

 

Thank you for choosing Charles Marlow for your upcoming rental.  Please read the following important terms and conditions which govern all the rental bookings we manage.  Hopefully, it helps to provide clarity on what is expected from you, Charles Marlow and the owner.

In addition, we highly recommend taking out a comprehensive travel insurance policy to provide extra protection. These are often provided by banks, or with health insurance policies, alternatively, policies can be taken out relatively inexpensively for single trips.

We are Copperstone Trading Ltd (Trading as Charles Marlow & Bros) from Archiduc Luis Salvador, 2a, Deia, Mallorca, 07179.  We act as an agent for the Owner who has authorised us to deal with your Booking on their behalf.  If there are any questions contained with anything you find in the below document please write to us at rentals@charlesmarlow.com.

 

Your Booking

A request to book a property does not guarantee that it will be accepted, and often availability needs to be checked.

We will provide you with written confirmation, acting as agents for the Owner, accepting your booking and upon acceptance, these terms and conditions bind Charles Marlow, you, and the Owner. The booking is a contract between you and the Owner – We act as the Owner’s agent.

 

Price & Payment 

The price of your stay, including any security deposit and any other extras, will be notified to you prior to your request to book being confirmed. Alongside this, We will confirm your payment schedule, i.e. dates when the first and final payments are due.

Whilst We endeavour to remind you, it is your responsibility to ensure payments are made on time to the bank account provided.  Funds should be cleared in our account by the designated date and in the current currency. Any bank or transfer charges shall be borne by you.

We reserve the right to cancel your stay if failure to pay any sums (including security deposit) by the due date does occur. Access to the chosen property will also not be admitted if any funds due are outstanding.

 

Security Deposit 

We will hold a security deposit as security against any damages caused by the lead guest and/or their guests during their stay in the property.

The security deposit amount varies per property and is detailed in the booking quote confirmation email. The security deposit is to be paid along with the second payment.

 

Within 10 business days after check-out, the security deposit will be returned in full, unless some or all is withheld to cover damage or excess cleaning, in which case an explanation will be provided. 

Costs incurred as a result of such damage, breakage and or loss shall be deducted from the security deposit (if applicable). We will make contact to discuss any damage discovered by the Owner or the House Manager. The security deposit is intended to cover most issues or damage. However, if damage exceeds the security deposit amount, the lead guest agrees to pay the additional expenses

 

It is the lead guest’s responsibility to provide the Agent with the correct bank details for the return of the security deposit.

 

Cancellation Terms

There will be no refund in the event of cancellation by the lead guest. In the unfortunate event that you do need to cancel, We will make every effort to re-book the villa. If re-booked at the same rate, a full refund will be issued. If We re-book the villa, a 250€ administration fee shall be deducted from the refund. 

If the property is sold prior to your occupancy and the new owner does not want to honour your booking, you will receive a full refund.

The Owner may have to cancel a Booking prior to the check-in time due to an event outside their control (such as fire, flood, failure of utilities or legislation) or if the Property will be unavailable as a result of a sale. We will contact you as soon as possible to let you know if this happens.  We will try to arrange alternative accommodation in a property in our portfolio of similar facilities and price and, if this is not possible, you will be entitled to a full refund.  This does not apply where you cancel because you are unable to travel or stay at the property as a result of the COVID–19 pandemic or other legal requirements affecting you; only where the Owner cancels because they are not permitted to have guests at the Property.

 

Check – In – Check – Out

Standard check-in time is 16:00 and standard check-out time is 10:00, unless otherwise agreed with Charles Marlow, the House Manager or the Owner.  Please check your original email booking quote for exact check-in and check-out times. Late check-in/out fees will be applied and may be withheld from your security deposit.

 

Noise

Please be respectful of neighbours and avoid making excessive noise that may disturb them. Failure to adhere to local noise regulations may involve the attendance of the local police. We or the Property Owner are not liable for any fines caused by noise disturbance to others.

 

Safety

Please be aware that some of our properties may have steps, uneven terrain or other hazards that may make access difficult. If you have any concerns about the suitability of a property for your needs, please contact Charles Marlow and We will do our best to advise you. It is also important to be aware of any laws or regulations that may apply to your stay, such as local fire regulations or rules around smoking. 

 

No Smoking

Smoking is strictly prohibited inside the property.

 

Liability

Neither We nor the Owner are liable for:

  1. a) death or personal injury caused by negligence 
  2. b) fraud or fraudulent misrepresentation; or
  3. c) loss or theft of personal items

 

Building Work

Occasionally, there may be scheduled building work in the vicinity of the villa. While We cannot control this, We will do everything possible to notify you of such work and its expected impact on your stay. Whilst We will do our best to manage the situation, We do not take responsibility for any disturbance from neighbours and/or local building work which is outside of our control

 

Occupancy and day guests

The overnight occupancy and daytime visitors is the total number of guests as advertised for the property. The Agency has the right to immediately evict renters and their guests if they are exceeding the allowed numbers. If evicted, you are not entitled to any rent refund.

 

Pets are only permitted in the property if specified within the booking. Any additional charges for the pets will be notified to you in advance of the booking.

 

Internet

Where internet is provided, there is no guarantee of a minimum speed, unrestricted bandwidth, or uninterrupted provision. We and the Owner cannot be held liable for any failure in the broadband access.

 

Water and Electricity Supply

We or the Owner cannot be held liable for any disruptions in water and electricity supply.

 

Marketing Material / Imagery

While We keep our illustrations, photographs and other imagery as up-to-date as possible, they are only illustrative and are subject to change.

 

General

These terms shall be governed by and construed in accordance with Spanish law.
